The family physician visa for medical leaves prescribed by medical specialists is no longer required

Order no. 1092/745/2020 amending and supplementing the medical certificate template as described below was published in the Official Gazette no. 583 of July 2, 2020.

 medical certificates issued by medical specialists may be submitted by employees to their employers without the visa/stamp of the family physician (the section dedicated to the family physician was removed from the template of the new medical leave certificate);

  • a new section was introduced for cases where medical certificates are delivered to take care of a sick child, where the treating physician will enter the personal identification number of the child for whom the certificate is delivered;
  • the medical leave certificates approved in the format existing until the publication date of Order no. 1092/745/2020 will be used by medical specialists/family physicians until the existing stock is exhausted, but not later than 9/30/2020;
  • the “Insured type” sections have been updated by checking, as appropriate, the situation of the insured, according to GEO no. 158/2005 and Law no. 346/2002 on the insurance for accidents at work and occupational diseases, as further amended and supplemented;
  • the medical leave certificate will continue to be issued on the basis of the certificate from the payer, except in the case of medical-surgical emergencies or Group A infectious-contagious diseases, mentioned in the list approved by government decision, as well as in the case of infectious-contagious diseases for which the isolation measure is established, determined by government decision (the payer shall mandatorily mention in the certificate the number of days of medical leave during the last 12/24 months, according to the certificate template provided in the Implementing Rules of GEO no. 158/2005, as further amended and supplemented);
  • the provisions of Order of the Minister of Health (MS) and the National Health Insurance House (CNAS) no. 1.092/745/2020 are applicable as of its publication in the Official Gazette.

We also recall that, in order to benefit from a medical leave, the employee must have a minimum contribution period, i.e. six months covered/contributed for in the last 12 months preceding the month for which the medical leave is granted.
